These Terms & Conditions (“Terms & Conditions” or “Agreement” or “Terms”) sets forth the terms and conditions for engaging with GlobeMentum, or interacting with this website, with our app, with our services, with any of our platforms, or with us, whether you are a customer or a donor or a visitor. The words “GlobeMentum”, “we”, “us”, or “our company” mean GlobeMentum, LLC, the legal entity (established in the Commonwealth of Massachusetts, United Stated of America), which operates this website and corresponding services. The word “GlobeMentum.com” (as well as all of its subdomains), “website”, “site”, or “platform” mean this website or app, whether it’s presented in the format of a website or an app. The words “you”, “your”, “yours”, “user”, “donor”, “subscriber”, or “customer” mean you the natural person who interacts with this website either as a visitor, or as a donor, or as a paying customer, and regardless of whether you are acting on your own behalf or on behalf of a company or entity. You may act only on your own behalf or on behalf of an entity of which you are a legal representative; you may not act on behalf of another natural person when interacting with this website. Your use of the site constitutes your understanding of, and agreement to, this Terms & Conditions.

This Terms & Conditions constitutes a legally binding agreement between you and us. By using this website or any of our platforms or services, you agree to be bound by all terms and conditions of this Agreement, and to comply with all its terms set out herein. You will also comply with any additional conditions that may be posted on this website. This Terms & Conditions may be modified from time to time, without notice. The date of the most recent version will appear on this page, and the Terms will be effective as of that date. You are responsible for keeping yourself informed about any modification(s) of this Terms by visiting this page, checking the date on this page, and reading the content of this page. Continued access and use of this site will constitute your acceptance of, and agreement to, the current version of the Terms & Conditions.

This site is not intended for persons under 13 years of age, and we do not knowingly collect information from, or provide services to, such persons. If you are under 13 years of age, do not attempt to become a customer, or a donor, or a subscriber, and do not send any personal information about yourself via any of the forms on our website, nor by using any other means. If we learn that a child under the age of 13 submitted personal information to us, or made a donation to us, we will promptly delete that information, or return that donation, or both.

GlobeMentum aims to raise awareness of the role individuals and small businesses play in the growing climate change that affects all of us on Earth, and their responsibility to take action to counter or reduce the negative effects. Blaming large organizations and governments, and demanding action from them is one way to hold people accountable. However, the polluting activities by individuals and small business play just as important role in the declining health of our environment, and of our own human bodies.

While our published pieces primarily focus on climate change issues as they relate to individual persons, families, and small businesses, we also include content related to larger organizations or governmental entities, or to climate change on a global scale—after all, its effects permiate throughout the world without being restricted to any particular geogrophical region or segment of the human population.

Your support will make a real difference in our work, and is truly appreciated. We represent a cause that affects all humans, and although we are not a non‑profit organization, we devote our time to serve this cause. That said, GlobeMentum is not a charity or a 501(c)(3) entity, therefore, your contribution will not be considered charitable donation, and will not be tax‑deductible; nor will it be refundable. Recurring donations may be cancelled by following the instructions in the footer of the email sent after a donation payment has been processed. Any cancellation of a recurring donation will take effect on the next billing date, provided that the cancellation was made at least one calendar day before that next billing date. However, we encourage you to consider the positive human impact of your donation before you cancel. While a resulting impact is often not immediate in organizations like ours, and there is no guarantee for delivery of such results, we will use our best efforts to allocate your contribution in ways that will help fulfill our purpose, help run our organization, and inspire more and more people to be part of the climate effort in order to make positive change.

By making a contribution, you represent and warrant that the funds used for making this donation are from legitimate sources, and that you are authorized to use that specific payment method which you use to make the contribution, and you authorize GlobeMentum, LLC to charge that payment method. Contributing does not establish any partnership, membership, customer relationship, joint venture, employment, or any type of affiliation between you (or the person or entity who is the legal holder of the account belonging to that payment method) and GlobeMentum, and does not provide you any special privileges. You agree that GlobeMentum does not have any fiduciary‑, accounting‑, performance‑, attribution‑, or other obligation to you in connection with the contributed funds, or in connection with any feedback or suggestion you may provide regardless of whether you provided such in a solicited or unsolicited context.

If we publish the names of donors in any form, we will do so only after obtaining permission from each donor. We may send you emails in connection with the donation you made, or wish to make. Occasionally, we may also send you emails with information that we think might be of interest to you, but we will not inundate you with emails. You may unsubscribe from receiving such emails by following the corresponding link in the footer of those emails; however, doing so will not unsubscribe you from the service or subscription for which you submitted your information. If you wish to unsubscribe, we encourage to reconsider it, as such informational emails are sent only on occasion.

In addition, GlobeMentum retains all rights, including but not limited to title, interest, copyrights, moral rights, rights of publicity, and other rights, to logos, trade marks, service marks, designs, trade secrets, and all content stated in the section titled “INTELLECTUAL PROPERTY RIGHTS” in this agreement, and all other intellectual property embodied by, or contained in, GlobeMentum.com (or any sites, platforms, publications, or media operated by GlobeMentum), or were created by GlobeMentum, or are the property of GlobeMentum LLC. All GlobeMentum intellectual property is protected by copyright, trade secret, and other intellectual property rights in the United States of America, and worldwide. All terms of the section “INTELLECTUAL PROPERTY RIGHTS” in this agreement apply to donor relationship, and to all relationships or conduct.

The words “donation” and “contribution”, the words “donate” and “contribute”, and the words “donor” and “contributor” are used interchangably.

When you sign up to receive our email newsletter or other communication from us, you provide your consent to receive such communication until the time you unsubscribe from that particular communication, or until the time we unsubscribe you. We may unsubscribe you (or remove you from any or all of our communication) for any reason, at any time, at our sole discretion. Therefore, some of the information on this website might differ from information in other sources. However, we aim to collect the data that best represents the current state of the climate change issue. We aim to bring attention to the overall direction of climate change that affects our Earth we inhabit (as opposed to trying to fabricate exact facts or statistics—which would be impossible, given the approximate nature of available information). We make the effort to evaluate the information we publish, but we do not guarantee that we will not mistakenly publish false information. The terms of this Agreement are governed in accordance of the laws of Norfolk County in The Commomwealth of Massachusetts, United States of America. Any legal action against GlobeMentum may be brought only in the courts of this jurisdiction. Notwithstanding the foregoing, nothing in this Agreement will prevent GlobeMentum from applying to any court to bring action for infringement of its property, including intellectual property, or for other violation against any person or entity.

This Agreement is the entire agreement between you and us, and supersedes all prior written or oral agreements or understanding between you and us.

The terms of this Agreement may be modified only by GlobeMentum, at any time, without notice, and in its sole discretion. The date of last update is posted in this Terms & Conditions, and the updated Terms & Conditions takes effect on that date.
